Terms of Service

By using Megaforms (the "Service"), operated by MEGA PROMOTING SRL("we", "us"), you ("Customer") agree to these Terms.
1. Account
You must provide accurate registration information and keep credentials secure. You are responsible for activity under your account.
2. Acceptable use
You agree not to use the Service to:
- Send spam or unsolicited communications
- Collect data from minors without parental consent
- Distribute malware, illegal content, or content that violates third-party rights
- Attempt to disrupt or compromise the Service
- Resell access without an Agency or Enterprise plan
3. Plans & billing
Paid plans are billed monthly or annually in advance via Stripe. You can cancel anytime; your plan remains active until the end of the paid period. We offer a 14-day money-back guarantee on the first paid month, no questions asked. After that, we do not refund partial months.
4. Plan limits
Each plan has limits (responses per month, forms, seats). When you exceed them, the public form may stop accepting new responses until upgrade or the next billing cycle. We will not delete data due to overage.
5. Data ownership
You own all data you and your respondents submit. We act as a processor on your behalf. We do not sell your data, do not train AI models on your data, and do not access your form data except to provide support when you request it.
6. Service availability
We aim for 99.5% uptime on Free/Pro/Business and 99.9% on Agency/Enterprise. Scheduled maintenance is announced. We are not liable for downtime caused by third-party providers (Stripe, OVH).
7. Termination
We may suspend accounts that violate these Terms with notice except in cases of imminent harm. You may cancel anytime. Data export is available before cancellation.
8. Liability
The Service is provided "as is". To the extent permitted by law, our liability is limited to the amount you paid in the previous 12 months.
9. Governing law
These Terms are governed by the laws of the Republic of Moldova. Disputes shall be resolved in the courts of Chișinău, unless mandatory consumer law requires otherwise.
